ALMARA Affiliate Terms

These Affiliate Terms apply exclusively to the ALMARA Affiliate partner model and must be read in conjunction with the General Partner Terms. In the event of a conflict, these Affiliate Terms take precedence over the General Partner Terms.
§ 1 – Subject Matter
Under the ALMARA Affiliate model, the Partner refers End Customers to the ALMARA Platform without providing experience services itself. The Partner receives a one-off commission for each successful referral resulting in a first booking by the End Customer, as set out in § 3.
The Affiliate model is directed primarily at hotels, concierge services, travel operators and similar businesses that regularly provide End Customers with activity and experience recommendations. The Affiliate Contract constitutes a brokerage agreement within the meaning of § 652 BGB. The Partner acts exclusively as an intermediary.
§ 2 – Referral Obligation and Scope
The Partner is not obliged to achieve a minimum number of referrals. No exclusivity obligation applies.
The Partner provides no experience service and assumes no responsibility for the quality, safety or delivery of the experiences referred. Responsibility lies exclusively with the respective experience provider (Spot or License Partner).
The Partner is obliged to make clear to End Customers that a referral is being made and that the contract for the experience is concluded directly with the experience provider via the ALMARA Platform. The Partner may not communicate prices that differ from those displayed on the Platform.
§ 3 – Affiliate Commission
The Partner receives a one-off commission for each first booking by an End Customer that is demonstrably attributable to a referral by the Partner (attribution per § 4), equal to the amount or percentage agreed in the Affiliate Contract.
First booking: The first completed and paid booking by an End Customer via the ALMARA Platform attributed to the Partner. Repeat bookings by the same End Customer do not give rise to a further commission entitlement, unless otherwise agreed in the Affiliate Contract.
Due date: Commission becomes due once the booking is fully paid and the experience has taken place without cancellation. Payment is made monthly in accordance with the payment terms in the General Partner Terms § 5.
Cancellations: In the event of full cancellation of the underlying booking by the End Customer, the commission entitlement lapses. Partial cancellations result in proportional adjustment of the commission.
Tiered model (future option): The Provider reserves the right to introduce a differentiated tiered model (e.g. Network / Concierge / Ambassador) with adjusted commission rates per tier at a later stage. Any such change requires written agreement and takes effect at the earliest from the start of the next Season.
§ 4 – Tracking and Attribution
Attribution of a booking to the Partner is made exclusively via the individual referral link or referral code assigned to the Partner in the Partner Portal.
A booking is deemed attributed if the End Customer used the Partner’s referral link within 30 days before the booking (cookie duration) or entered the referral code at the time of booking.
Where multiple affiliates are involved (End Customer used links from multiple Partners), the last-click principle applies: the most recently used referral link or code before the booking governs.
Manipulation of the tracking system (e.g. self-generated clicks, automated access, misuse of referral codes) entitles the Provider to immediately block the Partner and terminate the Affiliate Contract with immediate effect; commissions already paid out may be reclaimed.
§ 5 – Limitation of Liability of the Affiliate Partner
The Partner is not liable for the quality, safety, delivery or any other aspect of the referred experiences. Liability for the experience service lies exclusively with the respective experience provider (Spot or License Partner).
The Partner is liable to the Provider for damages arising from false, misleading or unauthorised statements by the Partner about ALMARA experiences or prices made to End Customers.
§ 6 – Brand Use in the Affiliate Context
The Partner is entitled to use the ALMARA brand and provided marketing materials exclusively for referral purposes under these Terms. Own marketing materials bearing ALMARA branding require prior written approval from the Provider. The Provider makes a basic marketing package (texts, images, referral links) available via the Partner Portal on request.
§ 7 – Term
The Affiliate Contract is open-ended and may be terminated by either party with three (3) months’ notice to the end of a calendar month. Commission entitlements arising from first bookings attributed before contract end remain in force after termination.
